Macao Patent Application Process

Extension of unauthorized patent application in China to Macao (optional stage):

***Applicants can directly submit a Macau extension for an authorized patent. If a Macau extension request is made before the patent is authorized, a two-stage extension request must be completed.

• China’s authorized invention patents are extended to Macau: 20 years from the date of application in China.
• Paris Convention direct application for Macau invention patent: 20 years from the date of application.

• China's authorized invention patent is extended to Macau: within 3 months after the announcement of China's invention patent authorization, and it cannot be extended.
• Paris Convention direct application for Macau invention patent: the earliest priority date/12 months from the application date.

Paris Convention direct application for Macau invention patent: After the applicant submits an invention patent application to the Macau Economic and Technological Development Bureau, the application fee must be paid within 8 working days. The invention patent application will be published in the "Macao Special Administrative Region Gazette" 18 months from the application date/priority date. From the date of publication to the authorization date, any third party may file an objection to the invention patent application. The applicant must file a substantive examination request within 7 years from the application date/priority date. The applicant can choose to request the substantive examination to be completed by the China National Intellectual Property Administration, and the patent will be authorized after passing the substantive examination.

Extension of Chinese authorized patent to Macau: After paying the application fee, the applicant must submit the [Patent Registration Book Copy] and [Patent Specification Authorization Announcement Text] issued by the National Intellectual Property Administration to the Macau Economic and Technological Development Bureau within 3 months after the announcement of the Chinese invention patent authorization (this period cannot be extended). The Chinese patent applicant recorded in it must be exactly the same as the applicant for the extension (otherwise, other supporting documents such as the declaration of change of the recorded items must be provided). If the documents are complete and there is no reason to refuse the extension, the approval time is only 3-4 months.

• Authorization: The applicant must download the patent certificate from the electronic application website or go to the Industrial Property Registration Application Counter on the 2nd floor of the Economic and Technological Development Reception Center after the expiration of the one-month appeal period from the date of the extension of the approval of the patent application published in the "Official Gazette of the Macao Special Administrative Region" or when an appeal is filed, after 5 working days after being informed of the final judgment of the court.
• Annual fee: It must be paid annually from the fourth year after the application date (including patents that have been approved for extension and those that have not yet been approved for extension), and must be paid within 6 months before the expiration date of the patent in the previous year. If it is not paid on time, the late payment fee can be paid within 6 months of the overdue payment period.
