TURKPATENT only conducts formality examination and prior art search for utility model patent applications, and does not protect methods or chemical products. The search is only for novelty and industrial applicability, and there is no requirement for inventive step. The applicant shall submit the prior art search request within 3 months from the date of issuance of the acceptance notice.

2-3 years

If the inventor or his client, the national office, or the information obtained directly or indirectly from the inventor leads to third-party disclosure, a novelty grace period of 12 months before the filing date/priority date can be enjoyed.

A 12-month novelty grace period is available if:

• The designer, his legal successor, or a third party arising from the information or activities of the designer or his legal successor
• Third party that harms the interests of the designer

PRV conducts formality examination and substantive examination of invention patent applications. The formality examination lasts for about 4 months, and the substantive examination does not need to be submitted by the applicant to start, and the examination is carried out automatically. After the actual examination is over, the applicant will receive the final granted notice.

• via Nationalization of PCT : 31 months from earliest priority date.

ROSPATENT conducts formality examination and substantive examination of utility models, and only one independent claim is allowed to be submitted, and utility model patent applications must have novelty and industrial applicability.
