The novelty grace period in Hungary is 6 months before the filing date if disclosure occurs:

- due to abuse of the rights of the applicant or his predecessors;
- because the applicant or the predecessor of the right holder has exhibited the invention at an exhibition duly recognized by the Hungarian Intellectual Property Office.

Examination of form only. The utility model application is examined for compliance with formal requirements, uniformity and registrability. If there is no special requirement, no novelty review will be conducted. The applicant can submit a request for delay in grant within 2 months from the filing date/priority date, and the grant can be delayed for 15 months at the latest.

IPVN conducts formality examination and substantive examination of invention patents. IPVN completes the formality examination within 1 month from the filing date. For the invention patent application through the via Paris Convention , the patent disclosure will be completed 19 months from the filing date/priority date. If the PCT enters the Vietnamese country, the invention patent will be filed in the country. Patent publication within 2 months after the application enters the Vietnamese national phase. Anyone can raise an opposition to the published patent within the opposition period.

The novelty grace period is 12 months before the filing date/priority date.

The novelty of an invention will not be affected if it is disclosed within 12 months before its patent application date or priority date:

• disclosed by the inventor;
• Disclosed by the Patent Application Accepting Authority,
• and that information is included in:
  • In other applications of the inventor, and disclose the application when the relevant authority should not disclose the application;
  • In applications submitted by third parties who have obtained information directly or indirectly from the inventor without the inventor's permission;
• Disclosure of the invention by a third party who has obtained information, directly or indirectly, from the inventor.

• Grant fee: The applicant should pay the granted fee, registration fee and first annual fee within 4 months after receiving the granted decision.
