PPH and GPPH Requests in Brazil

Brazil's newly revised patent law will come into effect on January 1, 2025. At the same time, the number of PPHs stipulated by Brazil's intellectual property rights this year has reached the limit.

Under the new regulations, the BRPTO will increase the number of PPH requests per year to a maximum of 3,200 PPH requests, and the number of PPH requests under the same IPC classification will be 1,000 PPH requests per year.

Another important change is that the BRPTO will now accept PPH requests for countries whose priority does not come from bilateral agreements. The BRPTO will also begin to accept substantive examination results of patentable subject matter from all countries participating in the GPPH, including PCT applications. In fact, the new rules remove the limit on the number of PCT PPHs.

Since BRPTO joined GPPH, the number of BRPTO partner institutions has increased from 23 to 35.
