The new European Design Regulation ("EUDR") will come into force on May 1, 2025, introducing new terminology, major changes to the annual fee periods and fees, and a new grace period for overdue annual fees.

Previously, the annual fee period for EU registered designs was due at the end of the month of the filing date, but under the new rules, from now on, the annual fee for EU designs will be due on the exact due date, and the grace period of 6 months will start immediately on the day after the due date.

The old system will still be used to determine annual fee deadlines and grace periods for designs filed before May 1, 2025. For example, if a EU design is filed on April 15, 2020, annual fees must be paid between November 1, 2024 and April 30, 2025, with a grace period from May 1 to October 31, 2025.
The new system will be used to determine annual fee deadlines and grace periods for designs filed after May 1, 2025. For example, if a EU design is filed on November 23, 2020 and its validity period expires on November 23, 2025, the annual fees must be paid between May 24, 2025 and November 23, 2025, and the grace period is from November 24 to May 23, 2026.

The annual design fee depends on when the design application is filed:

For annual fee renewal applications before May 1, 2025, the old fee schedule will still apply.
For annual fee renewal requests received on or after May 1, 2025, the new fee schedule will apply regardless of payment method or payment processing time.

Under the new renewal period, patent owners can choose to renew their designs before or after the new rules come into effect (May 1, 2025) to enjoy the most favorable fees. Annual fee payment can only be made within 6 months before the expiration of the design.
