Brazilian Industrial Property Institute Launches Prioritized Examination Procedure to Speed Up Trademark Registration Applications

Starting August 7, 2025, the Brazilian Patent and Trademark Office (BPTO) will officially launch the Priority Trademark Procedure, a new service designed to expedite the application and examination process for certain trademarks. Applicant eligibility will be based on legal criteria or strategic priorities aligned with the public policy objectives set by the BPTO.

A request for priority proceedings may be filed directly by the applicant or through an agent. In all cases, the applicant must submit a prescribed form, pay the prescribed fee, and attach supporting documentation evidencing eligibility for priority. For a shared application, all listed applicants must meet the requirements.

There are two ways to apply for the priority program:

  • Priority cases established by law: In these cases, services are provided free of charge and without quota restrictions.
  • Cases involving strategic objectives and public policies: These cases are subject to quotas and require the payment of fees.
