  • DKPTO conducts formality examination and substantive examination of invention patent applications. Danish patent applications can be filed and examined in English, but when the patent is granted the Claim need to be translated into Danish. The substantive examination starts automatically, and there is no need for the applicant to submit a request for substantive examination. DKPOT will conduct novelty search and patentability examination, and the applicant will receive the first search report within 6 to 7 months from the date of application. The patent application will be granted in about 1-3 years after the grant conditions are met.

  • DKPTO conducts only formality examination of utility model patent applications. It can be submitted in a foreign language, but the Danish translation must be completed within one month from the filing date. The applicant/anyone can submit a request for examination during the validity period of the patent, and DKPTO will conduct substantive examination after paying the corresponding fee. Method Claim are not allowed.

    Danish Utility Model Patent Search: PVSOnline - Patent & Varemærkestyrelsen (dkpto.dk)

    • Grant fee: The applicant shall pay the granted fee within 2 months after receiving the granted notice.
    • Annuity: pay year by year starting from the first year from the application date. If the annual fee is overdue, it can be paid within a grace period of 6 months, and a 20% late fee will be paid at the same time.
