The patent grant procedure is divided into two separate stages:

• The first stage is the formality examination stage, from the filing of the patent application to the publication of the patent application.
• The second stage is the substantive examination stage after publication. If the application meets the formal requirements, the Hungarian Patent Office will manage the filing date and perform a novelty search. The request for substantive examination can be made at the time of filing the application or at the latest within 6 months from the date of publication of the search report in the Official Gazette.

The design does not lose its novelty if it is disclosed by the designer in Japan within 12 months from the filing date/priority date.

In Australia, the acquisition of patent application for design is divided into two parts: registration and certification. Both of these are required to legally exercise design rights. After IP Australia's 8-week preliminary review of the design, the design patent will obtain a patent certificate. If you want to exercise the design patent right, you must go through 13 weeks of IP Australia's review and reply, and you will be certified after passing.

• Grant fee: The applicant should pay the granted fee, registration fee and first annual fee within 4 months after receiving the granted decision.
• Annuity: pay year by year from the 3rd year from the application date, the annual fee can be paid within a grace period of 6 months if the annual fee is overdue, and the penalty is 50% of the annual fee of the year.

The applicant should submit a request for substantive examination within 3 years from the filing date. The JPO makes an granted decision if it determines after review that no grounds for refusal have been found.

The RVO conducts only formality examination of design patent applications.
