Argentina Intellectual Property Amendment Opposition Procedure

The Argentine Trademark Office (TMO) has issued Resolution No. 295/2024, introducing a new procedure in opposition proceedings.

Argentina has officially launched the trademark opposition procedure since May 2018. Applicants and opponents have three months to resolve the opposition. If the opposition request is not withdrawn, the party responding to the opposition will be given 15 working days from the date of the notice to submit a reply and evidence.

Currently, the Argentine Trademark Office has revised the opposition procedure. Applicants must indicate their interest in the application and pay a $10 official fee so that the examiner of the Argentine Trademark Office can review the opposition. If the applicant fails to submit evidence and pay the fee, the examiner will consider that the applicant has no interest in the submitted trademark application, and the trademark registration application will be rejected. This resolution applies to all trademark applications that are currently undergoing opposition procedures and have not yet received a grant decision.
