Accelerated Examination Procedure for Patent Applications in Serbia

In the accelerated examination procedure in Serbia, there is no accelerated procedure similar to PPH, but a request for accelerated examination can be made based on the following conditions:

• In the event of an emergency procedure in a judicial proceeding, or at the request of a court, market inspection authority or customs authority, where an inspection supervision or customs procedure has been initiated, a request for accelerated examination may be made. In the event of a lawsuit due to infringement of an already published application, the applicant may submit a request for accelerated examination to the Patent Office through an emergency procedure and submit the following materials:
  • Request for substantive examination of the patent application and proof of payment of the examination fee
  • Evidence that the court infringement proceedings against the published application have been terminated before the competent authority makes a final decision on the application
