Prioritized Examination of Patent Applications in Argentina

In the process of patent application in Argentina, the applicant may apply for priority examination, namely Priority Patent Examination (PEP). Once the priority examination proposed by the applicant is approved, the patent application that qualifies for priority examination can be examined within 60 days, provided that the following requirements are met:

• For the first application, submit an affidavit stating that the invention has not been previously applied for in any other patent office
• Published in the Patent Gazette
• The third-party public comment period has ended and the substantive review fee has been paid
• No corresponding substantive examination
• Another accelerated procedure is not requested for the same application
• Submit completed search report
• If it is a small and medium-sized enterprise, you need to submit the small and medium-sized enterprise certification
